Terms and Conditions

Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

  • Cooling-off period: The period during which the consumer may exercise their right of withdrawal.

  • Consumer: The natural person who does not act in the course of business or profession and concludes a distance contract with the entrepreneur.

  • Day: Calendar day.

  • Long-term transaction: A distance contract concerning a series of products and/or services, the delivery and/or acceptance of which is spread over time.

  • Durable medium: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unaltered reproduction of the stored information.

  • Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.

  • Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.

  • Distance contract: A contract concluded within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, in which only one or more means of distance communication are used up to and including the conclusion of the contract.

  • Means of distance communication: Any means that can be used for the conclusion of a contract without the consumer and the entrepreneur being simultaneously present in the same location.

  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days without giving any reason. During the cooling-off period, the consumer shall handle the product and its packaging with care.
If the consumer exercises their right of withdrawal, they shall return the product with all accessories provided, and if possible, in its original condition, following reasonable instructions provided by the entrepreneur.

Article 3 – Applicability
These General Terms and Conditions apply to every offer by the entrepreneur, every distance contract, and all orders between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these General Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, it shall be indicated that the General Terms and Conditions can be inspected at the entrepreneur and will be sent free of charge to the consumer upon request.
If the distance contract is concluded electronically, the text of these General Terms and Conditions may, prior to conclusion, be made available electronically in a manner that allows the consumer to store them on a durable medium. If this is not reasonably possible, the consumer shall be informed where the terms can be inspected electronically and that they will be sent free of charge upon request.
If specific product or service terms also apply in addition to these General Terms and Conditions, the above paragraphs shall apply accordingly, and in case of conflicting terms, the consumer may rely on the provision most favorable to them.
If one or more provisions in these Terms are wholly or partially void or annulled, the remaining provisions shall remain in force. The void or annulled provision shall be replaced by a new provision that approximates the intent of the original as closely as possible.
Situations not covered by these Terms shall be assessed in the spirit of these Terms. Ambiguities regarding the interpretation of one or more provisions shall be interpreted in accordance with the spirit of these Terms.

Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this shall be explicitly stated in the offer. The offer is non-binding. The entrepreneur reserves the right to modify or adjust the offer.
The offer contains a complete and accurate description of the offered products and/or services, detailed enough to allow the consumer to make a proper assessment.
Images used in the offer are a faithful representation of the products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.
All images and specifications are indicative and do not give rise to claims for compensation or annulment. Colors in images may differ from actual product colors.
Each offer contains sufficient information to clarify the rights and obligations of the consumer, including:

  • Shipping costs;

  • How the contract is concluded and required actions;

  • Applicability of the right of withdrawal;

  • Payment, delivery, and execution methods;

  • Offer acceptance period or price guarantee period;

  • Fees for using distance communication tools if different from regular rates;

  • Whether the contract will be archived and how it can be accessed;

  • How the consumer can review and correct provided data;

  • Other languages in which the contract may be concluded;

  • Codes of conduct followed by the entrepreneur;

  • Minimum contract duration for long-term transactions;

  • Optionally: available sizes, colors, materials.

Article 5 – The Contract
The contract is concluded upon acceptance of the offer by the consumer and fulfillment of any stated conditions.
If acceptance is made electronically, the entrepreneur shall immediately confirm receipt. Until confirmation, the consumer may revoke the contract.
For electronic contracts, the entrepreneur shall implement appropriate technical and organizational security measures and ensure a secure web environment. Payments shall also be secured.
The entrepreneur may verify the consumer’s ability to meet payment obligations and other relevant factors. If valid reasons exist, the entrepreneur may refuse or condition acceptance.
The entrepreneur shall provide the consumer, in writing or on a durable medium, with information regarding:

  • The business address for complaints;

  • Withdrawal rights or exceptions;

  • Warranty and after-sales service;

  • Contract details as in Article 4;

  • Termination requirements for long-term agreements.
    For long-term transactions, this applies to the first delivery. Contracts are subject to product availability.

Article 6 – Right of Withdrawal
Consumers may cancel product purchases within 30 days without giving reasons. The period starts the day after receipt.
Products should be handled carefully and only used as necessary to assess retention.
Returned products must include all accessories, in original condition and packaging if possible, following reasonable instructions.
Withdrawal must be communicated within 30 days via written notice or email. Returned products must be shipped within 30 days, with proof of shipment. Failure to comply confirms the sale.

Article 7 – Costs of Withdrawal
Return costs are borne by the consumer.
Refunds must be made within 30 days after withdrawal, provided the product is returned or proof of shipment is supplied.

Article 8 – Exclusion of Withdrawal Right
Withdrawal may be excluded for:

  • Customized products;

  • Personalized products;

  • Products that cannot be returned due to their nature;

  • Perishable goods;

  • Products with prices subject to market fluctuations;

  • Loose newspapers and magazines;

  • Sealed media/software opened by the consumer;

  • Sealed hygiene products opened by the consumer.
    Exclusion must be clearly stated in the offer.

Article 9 – Price
Prices stated in the offer are fixed for the offer duration, except for VAT changes or financial market-linked products. Price increases within three months post-contract are only allowed by law. After three months, increases require consumer consent.
Prices are subject to typographical errors without obligation to deliver at incorrect prices.

Article 10 – Conformity and Warranty
Products/services must meet the contract, offer specifications, reasonable usability standards, and applicable legal regulations. Agreed suitability for special use is guaranteed.
Manufacturer warranties do not affect statutory consumer rights.
Defects or wrong deliveries must be reported within 30 days. Returns must be in original packaging and condition.
Warranty aligns with factory warranty but does not guarantee suitability for individual applications or advice. Warranty does not cover improper handling, repairs by third parties, abnormal conditions, or regulatory compliance issues.

Article 11 – Delivery and Execution
Orders are executed with due care, preferably within 30 days unless agreed otherwise.
Delays or partial fulfillment must be communicated within 30 days, allowing the consumer to cancel without costs and claim damages.
Replacement products must be clearly communicated; the withdrawal right cannot be excluded for replacements.
Risk transfers to the consumer upon delivery unless otherwise agreed.

Article 12 – Long-term Transactions: Duration, Termination, and Renewal
Termination: Consumers may terminate indefinite agreements anytime with a max 1-month notice. Fixed-term agreements may be terminated at the end of the period with the same notice.
Renewal: Fixed-term contracts may not be automatically renewed unless specific provisions for newspapers/magazines allow renewal up to three months with termination rights. Trial subscriptions end automatically.
Contracts over one year may be terminated after one year with 1-month notice, unless unreasonable.

Article 13 – Payment
Amounts due must be paid within 7 days of the cooling-off period unless agreed otherwise.
For service contracts, the term begins after confirmation. Consumers must report errors in payment details immediately. Late payments may incur reasonable costs.

Article 14 – Complaints Procedure
Complaints must be submitted within 7 days after detecting defects, clearly and fully described.
Responses occur within 14 days; longer processing times require acknowledgment with an estimated response date.
Unresolved complaints may be submitted to dispute resolution.
Valid complaints will result in free repair or replacement.

Article 15 – Governing Law
All agreements governed by these Terms and Conditions are subject exclusively to Dutch law, including for consumers residing abroad.
